TERMS AND CONDITIONS [The Boring but Necessary Bits!]
Ersham Lodge, Canterbury
In making a booking with Ersham Lodge you will be deemed to have accepted our terms and conditions and you should note the clauses dealing with the cancellation of bookings and limitation of liability. All information you provide to us must be true and accurate. If a problem occurs, whilst at Ersham Lodge, please inform us immediately so that the matter can be resolved.
Booking Contract
Your reservation is either an on-line booking, 'telephone’ booking or an ‘e-mail enquiry/booking’. For telephone bookings, your booking will be completed, deposit details will be taken and a booking confirmation if required by you will be e-mailed to you later that day. For e-mail enquiries and bookings made before 17.00 hours, your request will generally be responded to/confirmed that same day. Credit card details are taken at the time of booking to confirm the booking, and a non-returnable £20 may be taken if required. Guests must make sure that any booking confirmation e-mail accurately reflects their requirements. If the guest does not check their e-mail confirmation and clarify any mistakes within 24 hours, then cancellation charges may be applied upon any subsequent cancellation.
Any booking made by you with Ersham Lodge creates a contract upon the issue of a booking confirmation, whether on-line, verbally or by e-mail. The person who makes the booking with Ersham Lodge accepts these terms and is responsible for all necessary payment. This agreement is subject to English law and exclusive jurisdiction of the English courts. By agreeing to these terms and conditions you are entering into a contract between yourself and Ersham Lodge.
Ersham Lodge makes every effort to ensure that the information on our website is accurate to the best of our knowledge; however, we accept no responsibility or liability for failing to keep the information up to date or for any loss or inconvenience sustained as a result of reliance on the information provided, or for any inaccuracy, error or omission in, or loss, injury or damage caused in whole or part by, or failures, delays or interruptions of, the content or the website services provided. We do not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties. Links to any third party sites are provided for your reference only and do not imply any endorsement of the sites. Ersham Lodge shall not be liable for any failure or delay in performance of its obligations, which results directly or indirectly from any cause or circumstance beyond its reasonable control.
Payments
Unless otherwise agreed, all bookings must be paid prior to departure from Ersham Lodge. Payment by cheque [drawn on an English bank], traveller’s cheque, money order, or cash is welcomed. In the event of default of any of the terms and conditions, Ersham Lodge reserves the right to deduct the full payment from your credit/debit card details (provided at the booking stage to secure the booking) and the right to pass on to its guest any charges relating to credit card payments, and to pass on the costs incurred in pursuing debts either through the courts or via the services of our debt collection agency. You will also be responsible for payment of any charges made for damages that may be incurred by you during your stay.
Keys
If these are not surrendered upon departure or returned immediately upon request, a charge will be made for replacement keys, fob and locks as deemed appropriate and entirely at the discretion of Ersham Lodge.
Cancellation and amendments
Your rooms are guaranteed for your arrival date once your booking has been completed. Should you wish to cancel your reservation, you can do so by telephone or by e-mail. However, if cancelling by telephone or by e-mail, you cannot assume the reservation has been cancelled unless you receive from us confirmation of cancellation in writing by email. Reservations cancelled more than 7 days prior to the stay [from 2pm of the arrival date] are not chargeable. Cancellations under seven days from the booking are subject to a 100% charge for the first two night’s cost of each room booked and 10% of each remaining night’s accommodation cost. In the event of a "no show" at Ersham Lodge the guest will be liable for the full fee payable for entire booking duration.
Amendments and cancellation by Ersham Lodge
It is unlikely that we will have to make any changes to your accommodation arrangements, but in an emergency we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor, and in any case Ersham Lodge will make every attempt to notify you of any changes before your arrival. If we are unable to provide the accommodation booked, you will be entitled to a refund of all monies paid for that accommodation. In the unlikely event that Ersham Lodge cannot provide the booked accommodation, we will endeavour to find an alternative accommodation (of at least a similar standard), and we shall have no liability in respect of any other costs, losses or damages existing out of or in connection with relocation of accommodation.
Room types
Rates are subject to change without prior notice and are only guaranteed following confirmation of the contract.
The total number of people (including infants and children) using the accommodation must not exceed the occupancy agreed when making a booking, otherwise you may be refused access to the accommodation or charged an additional amount.
(a) Single rooms: Single rooms and twin bedded rooms for sole occupancy are available in Ersham Lodge. (b) Twin/ Double rooms: Ersham Lodge may occasionally allocate a twin even though a double room is reserved. If a double room is of paramount importance to you then we suggest that you contact us and we will endeavour to arrange this. (c) Extra beds/Family rooms: Ersham Lodge provides family room facilities, which can include foldable or rollaway beds, as opposed to standard single beds. A family room usually contains 1 Double bed plus a single bed and may possibly provide a further folding or rollaway bed or bunk beds. Either may result in a room of restricted space.
Behaviour
You must ensure that you or your party do not behave in a way which disturbs or causes offence or danger to others or which risks damage to property belonging to others. In such circumstances the proprietors and staff of Ersham Lodge reserve the right to terminate your stay forthwith, in which case our responsibility to you ceases immediately and there can be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you will be liable to reimburse Ersham Lodge damages for any expenses whatsoever as a result of your behaviour.
